1. Your acknowledgement of the terms and conditions of use

   1. By accessing the Linde Website you, the user, acknowledge and confirm that you have read, understood, and agree to the following terms and conditions of use. Furthermore, you agree to be bound by all applicable laws as well as any other applicable rules and conditions. If you do not understand or agree with these terms and conditions you must stop accessing and using the Linde Website.

2. Scope of right to use

   1. All text footage, pictures, graphics, user interfaces, visual interfaces trademarks, sound, videos, including corporate logos brands and artwork (collectively, "Content"), text footage, pictures, graphics, software, applications, sound samples, animations videos, corporate logos and brands, the layout of the Linde Website, as well as other content contained in the Linde Website, hereinafter jointly referred to as “Linde Website Content”, are protected by trademark and copyright law and other laws for the protection of intellectual property.
   2. Linde India does not grant any license rights or other rights regarding the use of the intellectual property rights in the Linde Website Content, unless otherwise specified herein. The copying, distributing, reproducing, forwarding, otherwise using of these intellectual property rights in the Linde Website or the Linde Website Content including the making available to third parties is not permitted without the prior written consent of Linde India.
   3. The content of press releases and other documents classified as public may be used in public communications save the condition that the permission granted hereunder does not apply to those parts of public documents which are protected by trademark or copyright law, or other legal regulations. This does not apply to those parts of public documents (within the meaning of Indian Evidence Act 1872) which are protected by trademark or copyright law, or other legal regulations.
   4. Access to or use of the Linde Website or the Linde Website Content from countries, where this access or this use is unlawful, is not permitted. In this case, and if the user wants to enter into business relations with The Linde Group, the user should contact representatives of The Linde Group in the respective country.
   5. Any other use of the Linde Website as well as the Linde Website Content is prohibited unless specifically permitted by these Terms and Conditions.

3. Restrictions of Use

   1. The user must in particular not, without the prior written consent of Linde India:
   1. use the Linde Website or the Linde Website Content for any fraudulent or unlawful purpose;
   2. use any registered or unregistered trademarks or signs on the Linde Website or in the Linde Website Content without the prior written consent of the respective owner;
   3. translate, modify, adapt, reverse engineer, decompile or disassemble the Linde Website or Linde Website Content in whole or in part;
   4. remove any notice of copyright, trademark, or other proprietary rights from the Linde Website Content;
   5. frame or otherwise embed Linde Website Content in your or a third party website;
   6. mirror any part of the Linde Website;
   7. create a database by systematically storing and downloading all or any Linde Website Content;
   8. use any robot, spider, site search application or retrieval application or other manual or automatic device to retrieve, index, "scrape," "data mine" or in any way reproduce or circumvent the navigational structure or presentation of the Linde Website or the Linde Website Content.
   2. Reproducing, republishing, distributing, changing or copying the contents of these pages, including framing or the use of any framing techniques, is strictly prohibited.
   3. Linde India reserves the right to deny access to the Linde Website at any time.

4. Trademark and Copyright, Rights of Use

   1. The entire content of the website, such as text, pictures, graphics, user interfaces, visual interfaces trademarks,, sound, videos, including corporate logos brands and artwork (collectively, "Content"), as well as the layout of Linde India web pages, is protected by the relevant trademark , copyright and other laws for the protection of intellectual property.
   2. Linde India expressly specifies that some of the pictures contained on the website are protected by the copyright of third parties, and the said text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music and artwork (collectively, "Content"), is a third party user generated content and Linde India has no control over such third party user generated content as Linde India is merely an intermediary for the same.
   3. No rights of license or other rights are granted via the website for the use of the intellectual property contained therein, including brands and copyright. Copying, distributing, reproducing, forwarding and otherwise using this protected intellectual property is not permitted without the written consent of Linde India. Intellectual Property Rights for the purpose of this Terms of Use shall always mean and include copyrights whether registered or not, patents including rights of filing patents, trademarks, trade names, trade dresses, house marks, collective marks, associate marks and the right to register them, designs both industrial and layout, geographical indicators, moral rights, broadcasting rights, displaying rights, distribution rights, selling rights, abridged rights, translating rights, reproducing rights, performing rights, communicating rights, adapting rights, circulating rights, protected rights, joint rights, reciprocating rights, infringement rights. All those Intellectual Property rights arising as a result of domain names, internet or any other right available under applicable law shall vest in the domain of Linde India and/or its affiliates are the owner of such domain name. You shall promptly notify us in writing upon your discovery of any unauthorized use or infringement.

5. No Warranties

   1. Linde India does not give any express or implied warranties, nor does it make any representations, nor does it assume any responsibility that
   1. the Linde Website or the Linde Website Content are available without interruption;
   2. the use of the Linde Website or the Linde Website Content will not infringe any third party rights;
   3. the Linde Website as well as the Linde Website Content are free from errors or are complete, accurate or up-to-date at all times;
   4. other web pages accessed by hyperlinks from the Linde Website, irrespective of whether these belong to affiliated companies of Linde India or third parties, do not infringe third party rights, or are free from errors, or that applicable data protection provisions are complied with; or that
   5. the Linde Website is free from viruses, bugs, malware, or similar malicious programs.
   2. Nothing on Website constitutes, or is meant to constitute, advice of any kind and any statements made on Linde India’s website regarding the future of the Company, are based on the beliefs and judgment of the management of Linde India and are therefore subject to risks and uncertainties. No assurance is given that these forward-looking statements will prove to be accurate and complete. 6. Limitation of Liability

   1. This Website, all the materials and products (including but not limited to software) and services, included on or otherwise made available to you through this site are provided on "as is" and "as available" basis without any representation or warranties, express or implied except otherwise specified in writing. Linde India continually checks and updates the information provided on its website. Although due care is taken, Linde India does not accept any liability for:
   1. defects in rights regarding the Linde Website or Linde Website Content;
   2. any loss or damage arising as a result of inhibited access or non-accessibility of the Linde Website as well as Linde Website Content;
   3. any loss or damage, which may arise from the use of the Linde Website or of any of the Linde Website Content; or
   4. the availability of the content of third party websites or any loss or damage resulting from their use, regardless of the purpose of use,

Save the provisions herein, the Linde Website and the Linde Website Content take into account the requirements of the country, in which the Linde company in charge is based.    1. The website contains links and references to third party websites. These links and references do not imply any endorsement of the content of third party websites by Linde India. Linde India has taken all reasonable measures to secure its computer resources and information contained therein under the relevant provisions of Information Technology Act, 2000 and rules thereunder and shall not be responsible for the availability or the content of third party websites and is not liable for any damage or injury resulting from their use, regardless of purpose. Links to third party websites are provided to users of Linde India’s website for their convenience only.

9. User Information

   1. To enable us to comply with your requests for information, you may be asked to supply personal data. Any such data is supplied by you completely voluntarily and is used solely for the purpose of complying with your request for information and the same shall not be retained longer than is required for the purpose for which the information is used or is required under any other law. All data is collected, stored, processed and used in accordance with applicable data protection law in compliance with the Reasonable Security Practice and Procedures.

10. Violation of these Terms and Conditions

    1. Linde India reserves the right to deny the user’s access to the Linde Website in whole or in part at any time in case of the user’s non-compliance with these Terms and Conditions or the user’s infringement of the rights of Linde India in the Linde Website or the Linde Website Content or any third parties’ rights.
    2. Furthermore, the user herewith indemnifies and holds harmless Linde India from and against all claims and damages arising out of or in connection with (i) the use of, or activities in connection with, the Linde Website and Linde Website Content, or (ii) any violation of these Terms and Conditions by the user.

11. Applicable Law

    1. These Terms and all questions and disputes relating to the use of this website are subject to the laws of India and inter alia the provisions of the Information Technology Act, 2000 and rules thereunder as applicable and as amended from time to time and also all applicable Domestic laws, rules and regulations (including the provisions of any applicable Exchange Control Laws or Regulations in Force) and International Laws, Foreign Exchange Laws, Statutes, Ordinances and Regulations (including, but not limited to Sales Tax/VAT, Income Tax, Octroi, Service Tax, Central Excise, Custom Duty, Local Levies) regarding Your use of Our service and Your listing, purchase, solicitation of offers to purchase, and sale of products or services and excludes the provisions of private international law and the United Nations Convention on Contracts for the International Sales of Goods (CISG).
